This Privacy Policy explains what information we collect, how we use and share it, the choices available to you, and your rights under applicable law, including the Texas Data Privacy and Security Act (Texas Business & Commerce Code Chapter 541) and the Texas Identity Theft Enforcement and Protection Act (Texas Business & Commerce Code Chapter 521).

This Policy applies to information collected through our website located at www.zkzlawpllc.com (the "Site"), through our SMS/text messaging program, through intake and consultation forms, through career applications, and through other direct interactions with the Firm, including by phone, email, and in person. This Policy does not apply to information we obtain in the course of representing a client, which is separately governed by the attorney-client relationship, the Texas Disciplinary Rules of Professional Conduct, and any applicable engagement agreement.

By using the Site or otherwise submitting information to us, you agree to the terms of this Privacy Policy. If you do not agree, please do not use the Site or submit information to us.

1.1 Information You Provide Directly

We collect personal information that you voluntarily submit to us, including when you fill out a contact or consultation request form, call or email our office, sign up for our SMS program, apply for a position with the Firm, or otherwise communicate with us. This may include:

  • Identifying information such as your first and last name, email address, phone number, and mailing address;

  • The content of any message, question, or description of your legal matter that you submit through our intake form, email, phone call, or in person;

  • Case- and injury-related information, which may include sensitive personal information such as details about an accident, medical treatment, health conditions, injuries, insurance information, employment information, and similar details necessary to evaluate or pursue a personal injury, wrongful death, or related legal claim;

  • Mobile phone number and consent records if you opt in to receive SMS text messages from us regarding your case or general updates;

  • Career and employment information, such as your name, contact information, desired position, office location, resume, cover letter, and LinkedIn profile, if you submit a job application; and

  • Any other information you choose to provide in free-text fields, attachments, or correspondence.
     

1.2 Information Collected Automatically

When you visit or interact with the Site, certain information may be collected automatically through cookies, pixels, log files, and similar technologies, including:

  • Responding to inquiries and scheduling free consultations;

  • Evaluating, opening, and managing a potential or actual attorney-client relationship and legal matter;

  • Communicating with you about your case, including by phone, email, mail, and SMS text message (where you have consented);

  • Preparing legal correspondence, demand letters, pleadings, discovery, and other documents necessary to represent you;

  • Processing employment and career applications;

  • Operating, maintaining, securing, and improving the Site;

  • Complying with our legal, regulatory, and professional responsibility obligations; and

3. SMS / Text Messaging Program

If you provide your mobile phone number and opt in through our website form, you consent to receive SMS text messages from ZKZ Law PLLC related to your case updates and general firm communications.

Opting Out: You may opt out of receiving SMS messages at any time by replying "STOP" to any SMS message you receive from us. After opting out, you will receive a one-time confirmation message, and we will cease sending SMS messages to your number.

Help and Support: If you need assistance or have questions about our SMS service, reply "HELP" to any SMS message you receive, or contact our customer support team at 713-584-9253.

Data Sharing: No mobile information, text messaging originator opt-in data, or consent will be shared with third parties or affiliates for marketing or promotional purposes. This restriction applies regardless of any other data-sharing provisions described elsewhere

in this Policy.

4. Cookies and Tracking Technologies

Our Site is built and hosted on the Wix.com platform, which uses cookies and similar technologies to operate the Site, remember preferences, analyze traffic, and, where applicable, support advertising features. These technologies may be set by us or by third-party service providers acting on our behalf.

Our Site does not currently respond to browser "Do Not Track" signals. Where required by applicable law, we will provide additional mechanisms to manage tracking preferences.

  • Professional and litigation needs: With medical providers, expert witnesses, investigators, co-counsel, opposing counsel, courts, mediators, arbitrators, and insurance companies as reasonably necessary to represent your legal interests;

  • Legal and safety reasons: To comply with a subpoena, court order, or other legal process, to enforce our agreements, or to protect the rights, property, or safety of the Firm, our clients, or others;

  • Business transfers: In connection with a merger, acquisition, or sale of firm assets, subject to applicable confidentiality and professional responsibility obligations; and

  • With your consent: For any other purpose disclosed to you at the time you provide the information, or with your consent.
     

We do not use or share information collected through our SMS program with third parties or affiliates for marketing or promotional purposes, as described in Section 3.

6. Data Storage and Security

We store personal information using our website platform (Wix.com), case management and cloud storage systems operated by our service providers, and our internal firm systems, located in the United States. We maintain administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. If we become aware of a breach of security involving sensitive personal information in a manner requiring notification under the Texas Identity Theft Enforcement and Protection Act (Tex. Bus. & Com. Code § 521.053), we will notify affected individuals and any required state agencies in accordance with that law.

7. Your Privacy Rights

Texas residents: The Texas Data Privacy and Security Act ("TDPSA," Tex. Bus. & Com. Code Ch. 541) grants Texas residents certain rights regarding their personal data. To the extent the TDPSA applies to our processing of your personal data, you have the right to:

  • Confirm whether we are processing your personal data and access that data;

  • Correct inaccuracies in your personal data;

  • Delete personal data you have provided or that we have obtained about you, subject to applicable exceptions (including our need to retain client file records and comply with professional responsibility and legal obligations);

  • Obtain a copy of your personal data in a portable format; and

  • Opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects.
     

We do not sell personal data or use personal data for targeted advertising as those terms are defined under the TDPSA. Because certain information we collect in connection with a legal matter (such as health or medical information related to an injury) may constitute "sensitive data" under the TDPSA, we will not process such sensitive data without your consent, except as necessary to provide legal services you have requested or as otherwise permitted by law.
 

Visitors from other states: If you are visiting our Site from outside Texas, applicable privacy laws in your state may give you similar rights. We will honor verifiable requests consistent with applicable law.

8. Attorney-Client Privilege and Confidentiality

Nothing in this Privacy Policy is intended to, and nothing in this Privacy Policy shall, waive, limit, or affect the attorney-client privilege, the attorney work-product doctrine, or any other privilege or protection applicable to communications with the Firm. Submitting an inquiry through our website, by phone, or by email does not, by itself, create an attorney-client relationship, and you should avoid sending confidential or sensitive information until an attorney-client relationship has been established.

9. Children's Privacy

Our Site and services are intended for individuals who are at least 18 years of age. We do not knowingly collect personal information from children under the age of 13, and we do not knowingly sell or process for targeted advertising the personal data of a known child under the age of 18, consistent with the TDPSA. If we learn that we have inadvertently collected information from a child in a manner inconsistent with this Policy, we will take reasonable steps to delete that information.

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, including to provide legal services, comply with our professional responsibility and record-keeping obligations under Texas law, resolve disputes, and enforce our agreements. Client file information is generally retained in accordance with the Firm's file retention policy and applicable rules of professional conduct.
